GENERAL CONTEST RULES
- General Conditions
These rules are in effect for any and all contest and games on ESPN 1420 (KKEA). From time to time there may be rules specific to a promotion in the event of conflicting rules the specific rules always have precedence. Rules for all promotions are posted on ESPN 1420’s web site and available for inspection at the ESPN 1420 offices and radio studio.
As a condition of playing the contest and by accepting prize, winner agrees to grant ESPN 1420 (KKEA) and its licensees, affiliates and assigns, the right to print, to publish, broadcast and use, worldwide in any media now known or hereafter developed, including buy no limited to the world wide web at any time or times, the winner’s name, portrait, picture, voice, likeness and biological information as new or information and for advertising and promotional purposes without additional consideration; and further without such additional compensation, appear for any presentation or other activity which may include filming/audio/video/electronic or other recording and/or interviews, as may be determined from time to time by ESPN 1420.
- Eligibility
ESPN 1420 contest and games are open to Hawaii Residents and active duty military and their dependants at least 21 years of age as of the date of entry and must be currently living in Hawaii.
Employees of ESPN 1420 (KKEA), Blow Up LLC, and all of related companies and their immediate family members (spouse or significant other, mother, father, sister, brother, daughter, son) or anyone residing in their household is not eligible. In addition to the above requirements players are eligible only if no-one in their households, including immediate family members in different households, has won a prize at $100 or more in the last 30 days.
By participating, you agree to these official rules and the decisions of ESPN 1420 (KKEA), Blow Up LLC, which are final and binding in all respects. No purchase is every necessary to participate in any of our contests or games.
- Promotional Period(s)
Promotional periods vary by individual contests & games and ESPN 1420 (KKEA) reserves the right to terminate all games, contests, and promotions at any time.
- Prizes
Prizes cannot be assigned or transferred prizes are non exchangeable and there is no cash redemption value. Air fare / Air transportation is always given in the form of airline tickets (in certificate form) and are subject to blackout dates. Hotel rooms when included in the prize packages are subject to similar guidelines.
ESPN 1420 (KKEA) reserve the right, at its sole discretion, to revoke any prize awarded and to disqualify any individual it finds, to be tampering with the entry process or the operation of the contest; to be in violation of the terms of service of the contest, to be acting in violation of the official rules; or to be acting in non-sportsmanlike or disruptive manner including theft or behavior with intent to annoy, abuse, threaten or harass any other person.
Use of robotic, automatic, programmed or like entry methods will void all such entries by such methods.
ESPN 1420 (KKEA) will prosecute any fraudulent activities to the full extent of the law.
Prizes will not be mailed. To claim prize, winner must provide proper proof of identification at900 Fort Street, Suite 700, Honolulu, Hawaii 96813. Pick up hours are Monday through Friday8:30 a.m. to 4:30 a.m. and closed on all holidays.
Prizes must be picked up in two weeks or less after the date of winning or hereby forfeited. No other prize will be awarded.
- Taxes
Any and all taxes are the sole responsibility of winner. Winner must execute and return an Affidavit of Eligibility and Liability Release, and a Publicity Release within 7 days of notification. Failure to return documents timely, or if prize notification or prize is not returned as non-deliverable, may result in disqualification.
- Liability
By accepting the prize, each winner agrees to release and hold harmless ESPN 1420 (KKEA), Blow Up LLC, its licensees, their parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance possession, the use or misuse of a prize, participation in any contest related activity, or participation in this contest.
ESPN 1420 (KKEA) is not responsible for any incorrect or inaccurate information, whether cause by the material, equipment or programming associated with or utilized in the contest and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the phone line.
- Disputes
As a condition of participating in this promotion, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this promotion, shall be resolved individually, without resort to any form of class action, exclusively, before a court located in the City and County of Honolulu having competent jurisdiction, which Court shall apply the laws of the State of Hawaii without regard for doctrines of Conflict of Law. Further, in any such dispute, under no circumstances will the participant be permitted to obtain awards for, and herby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering the promotion), and participant further waives all rights to have damages multiplied or increased.
